1. Acceptance of These Terms
These Terms of Use govern your access to and use of mobleymd.com and any related pages, forms, and online content (the “Website”), operated by Mobley MD (“MobleyMD,” “we,” “us,” or “our”), 1045 E 3900 S, Suite 200, Millcreek, Utah 84124. By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
Scope. These Terms apply only to your use of the Website. They do not govern any consultation, examination, procedure, treatment, or other medical services you may receive from Dr. Steven Mobley or the MobleyMD team. Those services are governed by separate patient intake forms, consent documents, financial policies, and agreements provided at the time of care.
You must be at least 18 years old to submit information through the Website. A parent or legal guardian must submit inquiries on behalf of a minor.
2. No Medical Advice
All content on the Website, including procedure descriptions, blog posts, videos, patient education materials, and before-and-after photos, is provided for general informational and educational purposes only. It is not medical advice and is not a substitute for an in-person evaluation by a qualified physician.
- No doctor-patient relationship. Browsing the Website, submitting a contact form, sending an email or text, or requesting information does not create a physician-patient relationship. That relationship begins only after an in-person or approved virtual consultation and completion of our patient intake process.
- Individual results vary. Every patient’s anatomy, health, and healing are different. Photos, testimonials, statistics, and descriptions of outcomes do not guarantee or predict your results.
- Candidacy is determined in consultation. Only a physician who has evaluated you can determine whether a procedure is appropriate for you.
- Emergencies. Do not use the Website, contact forms, email, or text messages for urgent or emergency medical needs. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Existing patients with post-operative concerns should call our office at (801) 449-9990.
3. Forms, Communications, and Third-Party Services
Information you submit. When you submit a form, you agree to provide accurate information and confirm that you are submitting it for yourself or with authority to act for the person named. How we collect, use, and protect your information is described in our Privacy Policy. Please do not include detailed medical history, photos, or other sensitive health information in general contact forms unless we have asked you to.
Calls, texts, and emails. By providing your phone number and email address, you consent to receive calls, text messages (SMS), and emails from MobleyMD about your inquiry, scheduling, and our services, including messages sent using automated technology. Consent is not a condition of purchasing any service. Message frequency varies, and message and data rates may apply. Reply STOP to opt out of text messages or HELP for help. You may unsubscribe from marketing emails at any time using the link in the email.
Financing. Financing applications linked from the Website are processed by third-party lenders. Approval, rates, and terms are set by the lender, not by MobleyMD, and are governed by the lender’s own terms and privacy policies.
Patient portal. Access to the patient portal is limited to current patients and is subject to the portal provider’s terms. You are responsible for keeping your login credentials confidential.
Third-party links. The Website links to other sites, including social media, our affiliated med spa, lenders, and video platforms. We do not control and are not responsible for the content, policies, or practices of any third-party site.
4. Use of the Website and Intellectual Property
Acceptable use. You agree not to:
- Use the Website for any unlawful purpose or in violation of these Terms
- Submit false, misleading, or someone else’s information without authorization
- Attempt to gain unauthorized access to the Website, its servers, or the patient portal
- Introduce viruses, malware, or other harmful code, or interfere with the Website’s operation
- Scrape, harvest, or collect content or data from the Website by automated means
- Send spam or unsolicited commercial messages through our forms
Ownership. The Website and its content, including text, graphics, logos, videos, and design, are owned by or licensed to MobleyMD and protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use. Any other copying, distribution, or modification requires our prior written permission.
Patient photos and testimonials. Before-and-after photos and testimonials are shared with patient consent. They may not be copied, downloaded, reposted, or used for any purpose. Testimonials reflect individual experiences and are not a guarantee of results.
5. Disclaimers and Limitation of Liability
As-is. The Website is provided “as is” and “as available.” We work to keep information accurate and current, but we make no warranties, express or implied, that the Website will be error-free, uninterrupted, secure, or free of harmful components, or that its content is complete or up to date.
Limitation of liability. To the fullest extent permitted by law, MobleyMD and its physicians, staff, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the Website or its content. This section does not limit any liability related to medical services, which is governed by separate agreements and applicable law.
Indemnification. You agree to indemnify and hold MobleyMD harmless from claims arising out of your misuse of the Website or violation of these Terms.
6. General
Governing law. These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Any dispute relating to the Website will be brought in the state or federal courts located in Salt Lake County, Utah.
Changes. We may update these Terms at any time by posting a revised version on this page. The “Last updated” date shows when they last changed. Continued use of the Website after changes means you accept them.
Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
