Mobleu MD ("MobleyMD," "we," "us," or "our") operates the website www.mobleymd.com (the "Site"). This Privacy Policy explains how we collect, use, share, and protect information when you visit the Site, fill out a form, contact us, or otherwise interact with us online.
This policy covers information collected through the Site. If you become a patient, the health information we create or receive while providing care is protected under the Health Insurance Portability and Accountability Act (HIPAA) and described in our separate Notice of Privacy Practices. If this policy and our Notice of Privacy Practices conflict regarding protected health information, the Notice of Privacy Practices controls.
1. Information We Collect
Information you provide to us. When you request a consultation, submit a contact form, subscribe to updates, call, text, or email us, we may collect your name, email address, phone number, mailing address, date of birth, the procedures or services you are interested in, appointment preferences, and any information you include in a message. If you choose to upload photos for a virtual consultation, we collect those images as well.
Information collected automatically. When you use the Site, we and our service providers may automatically collect your IP address, browser type, device type, operating system, referring website, pages viewed, time spent on pages, links clicked, and general location derived from your IP address. We collect this through cookies, pixels, tags, and similar technologies.
Information from third parties. We may receive information from advertising platforms, review sites, scheduling or financing partners, and social media platforms when you interact with our content or choose to connect with us through those services.
2. How We Use Information
We use the information we collect to respond to your inquiries and schedule consultations; provide information about our procedures, pricing, and financing options; send appointment reminders and, where you have consented, marketing communications; operate, maintain, and improve the Site; understand how visitors use the Site and measure the effectiveness of our advertising; protect against fraud, spam, and security threats; and comply with legal obligations.
3. How We Share Information
We do not sell your personal information. We may share information with service providers who perform services on our behalf, such as website hosting, form processing, scheduling, email and text messaging, analytics, and advertising, and who are contractually required to protect it. Where a vendor receives protected health information, we require a Business Associate Agreement as required by HIPAA.
We may also disclose information when required by law, subpoena, or court order; to protect the rights, property, or safety of MobleyMD, our patients, or others; or in connection with a merger, sale, or transfer of all or part of our practice.
4. Cookies, Analytics, and Advertising
We use cookies and similar technologies to operate the Site and to understand and improve its performance. We may use analytics tools such as Google Analytics and advertising tools such as Google Ads and [Meta, if applicable] to measure site traffic and the performance of our ads.
We configure these tools to avoid sharing information about specific medical conditions or procedures you've inquired about with advertising platforms in a way that identifies you. [Confirm this with your actual setup before publishing — see note below.]
You can control cookies through your browser settings. You can also opt out of interest-based advertising from participating companies at optout.aboutads.info. Some browsers send "Do Not Track" signals; because no uniform standard exists, the Site does not currently respond to them.
5. Text Messages and Email
If you provide your phone number and consent to receive text messages, we may send appointment reminders, follow-ups, and, if you separately agree, promotional messages. Message and data rates may apply. You can opt out at any time by replying STOP, and reply HELP for help. Consent to marketing messages is not a condition of receiving care. You can unsubscribe from marketing emails using the link in any email.
6. Photos and Testimonials
We will not post patient photos, before-and-after images, names, or testimonials on the Site or social media without your written authorization. Photos you submit through the Site for a consultation are used only to evaluate your inquiry and are handled securely.
7. Data Security
We use reasonable administrative, technical, and physical safeguards to protect your information. However, no website, internet transmission, or storage system is completely secure. Please avoid sending detailed medical information through standard email or general contact forms; you can share it during your consultation instead.
8. Data Retention
We keep personal information for as long as needed to fulfill the purposes described in this policy, including legal, medical recordkeeping, and regulatory requirements.
9. Your Choices and Rights
You may request to access, correct, or delete personal information we hold about you that is not part of your medical record, or opt out of marketing communications, by contacting us using the information below. Depending on where you live, you may have additional rights under applicable state law. Patients have specific rights regarding their health records, which are described in our Notice of Privacy Practices. We will verify your identity before fulfilling a request.
10. Children's Privacy
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Site. If you believe a child has provided us information, please contact us and we will delete it.
11. Third-Party Links
The Site may link to third-party websites, such as financing providers, review platforms, and social media. We are not responsible for the privacy practices of those sites and encourage you to review their policies.
12. Changes to This Policy
We may update this Privacy Policy from time to time. The updated version will be posted on this page with a revised effective date.
